I am planning on creating a site that is like another site...
this other site is a proper website... like legally and everything...
It's MySpace.... lol


I would like to know if it is allowed (legally) to mention MySpace in an advertisement of my website... (eg. "better then myspace")

with advertisement I mean Internet, Television, Radio, Billboard, etc...

I live in australia if that makes any difference...

Not sure to be honest, but I don't think I would want to risk it.

MySpace is coming down HARD on people using their site for advertising, they have eager lawyers and deep pockets.

Make sure you are fully covered before trying this.

Again, I don't know the answer I'm afraid, but has anyone here seen the PS3 VS Wii ad? In a similar way, it showed the Wii to be superior to the PS3. It's probably best to steer clear of stuff like that unless you can get an answer from someone in the know. Assuming your sites better than MySpace though, the social side of the site may take care of this for you if people agree and tell their friends ;)

To be honest id sell your site as something new not something old.

the whole MySpace clone thing is sort of wrong...
It's main purpose is for musicians of sorts to create accounts uploading images, videos and sound files of their music.
there will also be a blog involved, if they wish to use it.

Think of it as a mini-website with the inclusion of a blog.

I will not go into detail as of yet since the site isn't up and running yet.


Although it would be better to sell my site as something new, it would be easier to sell my site as "a better myspace" in some advertisements.


still, my question remains unanswered as, well, no one actually knows the answer...
